Overview
The Tea Party arose as Americans awoke to the fact that our country is reaching a tipping point. The national debt has become so large that in in 2010 the chairman of the Joint Chiefs of Staff declared it to be the single biggest threat to our national security. This debt is simply a symptom of the disease, it is not the disease. The national debt is generated by excessive federal spending – illegal federal spending. There you have the root of the problem: the United States Constitution explicitly limits the authority of the federal government, but We The People have failed to enforce those explicit constitutional limitations. We have been derelict in our duty as citizens.
The root of the problem is unlawful government and its seed is ignorance. It is time for each of us to take our civic duties seriously again. Who is to blame for the actions of a spoiled and disobedient child? That answer is obvious. If we mean to correct our disobedient child, then we must understand our sacred responsibilities as citizens of this great nation. Only through knowledge will we be able to root out tyranny. We can be ignorant or free, but we cannot be both. In this section, we will provide you a primer on the basic civics you will need to defend our Constitution. There is one last important note about the root of our problems. The Declaration of Independence reads "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable rights, that among these are life, liberty and the pursuit of happiness.". This document clearly states that our freedoms and rights derive from God, and not from any law created by man. The Constitution is infused with and embodies Christian morality, it protects Man's life, liberty and creativity. Our freedoms derive from God, and restoring our liberty is a moral imperative. We believe that to find the path to freedom, your moral compass must point true North.
Unconstitutional is Illegal
We want to be clear about something: The United States Constitution is the supreme law of our land. This means that all other laws are subject to it; that any activity which is unconstitutional is illegal. This is a very important idea, because in times of government corruption it is ultimately up to the citizens to assure that laws are enforced. AmericaAgain! Trust is designed to enforce just one law – the U.S. Constitution – in the criminal courts of all 50 States.
Violating America’s supreme law is a crime, which makes members of Congress who violate that law criminals. Too many of us see the word unconstitutional as an abstraction, but the U.S. Constitution is very clear. Those who violate it are criminals, and they are keeping our republic on the ropes. Thus, when you hear the word unconstitutional, think illegal. It’s time to take our condition seriously; we have a duty to protect and uphold the supreme law, by bringing to justice those in Congress who are willfully violating it.
The Broken Chains of the Constitution
The sovereign states did not quickly ratify our Constitution. Citizens feared the power of a central government, having fought to escape British tyranny. To convince the state legislatures to ratify the constitution, James Madison, Alexander Hamilton, and John Jay wrote a series of treatises to explain the intent and mechanisms within the Constitution. In the Kentucky Resolutions, Jefferson wrote "In questions of power, then, let no more be heard of confidence in man, but bind him down from mischief by the chains of the Constitution." Our federal employees in all three branches have slipped free of those chains, and many of them now openly flaunt their disobedience.
The Executive Branch
As chief executive, the president of the United States has often acted as the ringleader in crimes perpetrated by the federal government. Consider Obamacare, the Patriot Act, and the Social Security Act. To meet the supposed ‘crisis’ of the day, a president requests that Congress confer new powers on him and the government; historically, Congress has been happy to grant his requests for illegal powers.
The Legislative Branch
Take the video below for example. Representative Pete Stark is the poster-boy for arrogance and disregard for the Constitution. He is not alone. There are many in congress who also thumb their noses at the Constitution.
The exasperated citizen in the video above is a patriot and an inspiration. We applaud her. She is on the right track, understanding that the U.S. Constitution lays down the rules for what Congress can do, regardless what politicians may want.
The Judicial Branch
Radio commentator Rush Limbaugh jokingly refers to the U.S. Ninth Circuit Court of Appeals as the ‘Ninth Circus’ because it is populated by activist judges who blatantly ignore the Constitution. Any schoolchild can read Article I, Section 8 of the Constitution and the Tenth Amendment, grasping the 17 enumerated powers that we granted to federal government.
Yet, federal courts regularly refuse to read the Constitution as written, and the U.S. Supreme Court regularly fails to enforce it, choosing stare decisis (former rulings or precedent) rather than obeying the Supreme Law of the Land. For a century, Congress has passed laws that are clearly no laws at all, because they violate the U.S. Constitution, yet the U.S. Supreme Court has repeatedly failed to arrest these violations of the highest law.
Your Apex Sovereignty
It's vital that you understand that the apex sovereign in the United States – is you! Those who would maintain their power and control would have you believe that America's organizational chart looks like the one on the left. According to our Constitution, the graphic portrayal of American government is the one on the right.

That’s right; there’s no higher authority under our system of government, than We The People. Too many Americans have believed the lie for too long. The apex sovereignty of the American citizen is a key concept. All power derives from We The People.
State Trumps federal
The several states are the creator parties of the Constitution; in other words, the States created the federal government. We say that the federal government is the creature that was created by the States. Obviously, the creator has higher authority than that which is created; therefore, the States have higher authority than the federal creature. Look again at the the figures in Your Apex Sovereignty, State is over federal.
To emphasize this point, you will notice that we never capitalize the word federal. The federal government is our creature, they are our employees and our public servants. We The People are the true masters of this great republic, and it is time that we remind our servants of their place.
State Checks federal
The Constitution was devised with systems of checks and balances. When functioning properly, each of the three branches of the federal creature should check overreaches of power by the others. As you read in The Broken Chains of the Constitution, you saw that today all three branches have colluded to usurp power from We The People. Alexander Hamilton wrote that the States could check federal power, and vice versa, and that it would be We The People who infallibly would decide the victor in conflicts between State and federal (emphasis added):

Don't you think it's time that We The People threw our weight onto the scales of power? Has there ever been a greater need in American history for the people to choose to be the masters of our own fate? Also make note of the first sentence: "provided the citizens understand their rights and are disposed to defend them". Do you know your rights and are you disposed to defend them?
State Judges Must Defend the Constitution
Article VI, Clause 2 of the United States Constitution reads:
This section of the Constitution clearly states that every judge in every state is bound by the Constitution. This means that our State judges must must not only obey but must enforce the Constitution. This may not seem important now, but it is vital that you understand this: this 'Supremacy Clause' is one of the keys to our freedom.
Summary
We see that all three branches of our federal creature have colluded to break the supreme law of the land. These lawbreakers are criminals and their activities are illegal. The person responsible for bringing these lawbreakers to justice is you, because you are the top sovereign; together, We The People are the rulers of this land. As the creators of the federal government, the States have the authority to assess whether or not its employees have broken the law. If we know our rights, and are disposed to defend them, then the authors of the Constitution expected us to throw ourselves into the balance, thus determining the winner in conflicts between the States and the federal creature. Finally, our State judges are bound by the Constitution to defend and uphold the Constitution.
